A 61-year-old Pitt Meadows man who posted lewd photographs of himself to a much younger female neighbour will spend the next six months under house arrest.
Momchilo Michael Zivojinovich was handed a 12-month conditional sentence on Monday six months after he pleaded guilty to one count of mailing obscene matter.
Zivojinovich admitted he sent a 24-year-old woman who lived in his townhouse complex two photographs of his genitals.
Sexually explicit notes were hand-written on the back of both photographs.
His lawyer, Frank Dorchester, cited childhood sexual abuse as a factor that influenced Zivojinovich’s behaviour.
“There is evidence of a correlation between being abused and doing something yourself,” Dorchester told the court.
Fingerprints found on the photographs led police to Zivojinovich, who was in the police database because of a previous conviction on six counts of making indecent phone calls.
Zivojinovich is confined to his townhouse for the first six months of the conditional sentence, but can leave for medical emergencies, doctor’s appointments, employment and to walk his dog.
For the remaining six months, Zivojinovich will be bound by a curfew from 10 p.m. to 7 a.m.
Besides the conditional sentence, he also received two years probation order, must abstain from and alcohol, attend counselling and have no contact with the victim.
