A JUDGE in a case of alleged assault by a man against local police officers ordered prosecutors to turn over information to the defence about the officers involved today.
The judge granted the application put to the court from Shane Parker through his lawyer Terrance Hudson for disclosure of information that may be relevant to his defence against charges of assaulting a peace officer and willfully resisting or obstructing a peace officer on two dates last year.
Disciplinary records of the nine officers allegedly involved are part of the disclosure.
The paragraphs of the affidavit that were allowed to be disclosed are the following:”a. All video footage taken at the RCMP Detachment on June 19, 2010 and August 7, 2010; b. All audio recordings taken at the RCMP Detachment on June 19, 2010 and August 7, 2010 if not already provided;c. All officer notes taken on either June 19, 2010 or August 7, 2010; d. The names and contact information for all witnesses to the incidents that occurred on June 19, 2010 and/or August 7, 2010; e. All witness statements and recordings of witness statements taken with respect to the June 19, 2010 or August 7, 2010 incidents; f. The cell guard logs from June 19, 2010 and August 7, 2010 as I [Shane Parker] understand that apparently paramedics signed off that I was medically fit even though the paramedics were not permitted to examine my injuries or discuss them with me; g. All RCMP reports prepared in relation to either June 19, 2010 or August 7, 2010, including any reports prepared as a result of the public complaint investigation of these officers conducted by Sgt. Heidi Wild of the RMCP detachment in Prince George; h. The disciplinary records pertaining to the following officers: Cpl. Travis De Coene; Const. Isaac Couture; Const. Robert Hull; Const. Chad King; Const. Trevor Mack; Const. Stu Egers; Const. Kendra Felkar; Const. Richard McRae; and Const. Brian Heideman.”I am also asking that the Court require the RCMP to disclose any complaints involving these officers with respect to their use of excessive force in the past five years. I am further asking for disclosure of the sections of the RCMP training and/or policy manuals with respect to the following issues: a. Procedure and training regarding arrests; b. Procedure and training regarding the use of soft hand techniques; c. Procedure and training regarding the use of hard hand techniques; d. Procedure and training regarding the use of OC (pepper) spray, as well as medical treatment following the deployment of same; and, e. Procedure and training regarding providing detainees with medical treatment while they are in custody.”The next court date for the case is expected to be March 22 for arraignment.
