This morning, a Supreme Court Justice dismissed a delay application brought forward by Martin Gentles.
Gentles and his lawyer, Ken Walker, made the argument Monday that there was undue delay surrounding charges against him relating to the April 2012 collision on Carson Drive which caused the death of Rayel MacDonald and the serious injury of her friend, Alysha Mullett.
Gentles will be sentenced, maybe as early as today, in Williams Lake Supreme Court on a conviction of impaired driving and fleeing the scene of collision.
He was found not guilty of the more serious charges of impaired driving causing death and impaired driving causing bodily harm following a trial in Williams Lake that wrapped up in December of 2014.
Crown has asked for a three to three and a half year custodial sentence while defence has proposed a non-custodial sentence with higher than normal fines.
Justice John D. Truscott adjourned court until 3:30 and said he couldn’t promise that he would impose a sentence today.
