An unendorsed warrant was issued at 9:55 a.m. on March 21 for Derek Jason MacLean in the Victoria Law Courts.

McLean was required to appear in court at 9 a.m. on March 21 on one count of mischief obstructing the use or enjoyment of property and one count of wilfully resisting or obstructing a peace officer. McLean did not attend, resulting in the warrant being issued. He last appeared in court by video while in custody on March 15. He was released the same day.

In 2012 a Kamloops judge issued a warrant for McLean, who was released prematurely from custody due to a paperwork mix-up. At the end of his preliminary inquiry a breach charge was dropped, but based on how the paperwork was completed the breach charge was the only item holding him in custody despite the fact that he should have been detained for more serious allegations.
