An RCMP officer could possibly face charges related to a motor vehicle accident in Coldstream last year.
The Independent Investigations Office of B.C.’s chief civilian director has completed a review of a file related to an Aug. 6, 2016 accident and has submitted a report to Crown counsel for consideration of charges.
“Pursuant to the Police Act, the chief civilian director must refer a file to Crown counsel for consideration of charges if the CCD identifies that an officer may have committed an offence under any enactment,” states the IIO.
“In approving charges, Crown counsel must be satisfied not only that an offence may have been committed, but that the commission of an offence can be proven in court beyond a reasonable doubt.”
Crown Counsel’s policy for assessment relies on a two part test:
There must be a substantial likelihood of conviction based on the evidence gathered by the investigating agency.
A prosecution must be required in the public interest.
At about 8 a.m. Aug. 6, 2016, an accident occurred when an RCMP vehicle and a motorcycle collided on Highway 6, near Brewer Road.
The two Kelowna occupants of the motorcycle — a 46-year-old man and a 25-year-old woman — were taken to hospital with non-life threatening injuries while the RCMP officer was uninjured.
Once Crown counsel has made a decision on the file, an update will be posted www.iiobc.ca/cases.
