Fine ends ‘landfill rage’ case

A Salmon Arm man has been fined $690 for driving without reasonable consideration relating to an incident of “landfill rage” in January 2011.

Barry Tunzelmann pleaded guilty to the lesser Motor Vehicle Act charge, after originally facing a criminal charge of dangerous operation of a motor vehicle.

He was charged following a Jan. 24 incident at the Salmon Arm landfill which saw landfill employee Debbie Dystant injured when Tunzelmann struck the gate with his vehicle.

According to an RCMP report from the incident, Tunzelmann arrived at the landfill at approximately 4:30 p.m. and become irate when told the facility closed at 4 p.m. and he could not dump his garbage. He dumped his garbage anyway and, on his way out, hit the gate. It swung open and struck Dystant in the head causing her to lose consciousness.

The CSRD also banned the man from the landfill for one year.

Tunzelmann must pay the court-imposed fine before the end of April.
