The woman charged with the 2009 murder of a Grand Forks boy has been denied day leave.
Kimberly Ruth Noyes is to remain in custody and reside at a forensic psychiatric hospital in the Lower Mainland after being denied a request for a one-day release.
Paula Thorburn, a registrar with the B.C. Review Board, noted that the board held a hearing on Sept. 23.
“The board made a custody disposition under the same terms as her previous disposition,” Thorburn stated in an email in regards to the hearing under section 672.81(1).
Section 672.81(1) of the Criminal Code notes that “a review board may hold a hearing to review any of its dispositions at any time, of its own motion or at the request of the accused or any other party.”
Her terms remain the same under the directions of the review board, including general direction and supervision by the director of the adult forensic psychiatric services; she may not acquire, possess or use any firearm, explosive or offensive weapon; and that she present herself in front the review board when requested.
Noyes was charged with the slaying of 12-year-old John Fulton in Grand Forks.
She was originally charged with second degree murder but was found not criminally responsible on account of a medical disorder by the Supreme Court of British Columbia at Rossland on July 23, 2010.
Noyes was ordered to be held in custody at the forensic psychiatric hospital until further disposition.
Fulton went missing Aug. 15, 2009 and RCMP and Grand Forks Search and Rescue conducted a massive ground and air search. This led to the discovery of Fulton’s body in Noyes’ home.
