Man sues Abbotsford Police, claiming injuries

The civil suit alleges that police used unnecessary force during an incident in January 2012.

A Surrey man has filed a notice of civil claim against the Abbotsford Police Department (APD) and several of its officers, alleging he was injured during an incident in January 2012.

Adam Muxlow, 32, filed the claim on Jan. 9 in B.C. Supreme Court in New Westminster, and is also suing Finnegan’s Pub and Grill.

He claims that he was proceeding to leave Finnegan’s – located on King Road in Abbotsford – on or about Jan. 15, 2012 when employees tackled him to the ground “against his will without notice or without valid reason to do so.”

Muxlow states in the claim that he was then escorted outside and was on the ground when four APD officers arrived on the scene.

He alleges that the officers used unnecessary force, handcuffed him against his will and without valid reason, and placed the handcuffs incorrectly.

Muxlow states that he suffered “significant injuries,” including nerve damage to his left wrist, cuts and bruises to his face, and damage to his left arm/hand and right shoulder.

Since the incident, he says he has suffered from headaches, stress, insomnia, anxiety and depression.

He claims that the injuries have caused him pain and suffering, permanent physical disability, and loss of earnings.

Muxlow is seeking damages for what he terms in the claim as “negligence, assault, battery, gross negligence, and willful and malicious conduct” by the defendants.

The APD has not yet filed a response to the claim, nor have any of the allegations been proved in court.
