A trial is scheduled to begin Monday, April 15 in Chilliwack Supreme Court for pot activist Tim Felger, who was charged with drug offences in Mission.
Felger has been charged with two counts of trafficking in a controlled substance and two counts of possession for the purpose of trafficking.
He was arrested in March 2011 after allegedly selling marijuana out of his store Das Bhang, located at the corner of Horne Street and North Railway Avenue in downtown Mission.
Felger moved to that location after running a similar business, Da Kine, on Essendene Avenue in Abbotsford. He was evicted from that site in June 2010, after his landlord obtained a court order on the grounds that Felger owed $53,000 in back rent.
Prior to that, the City of Abbotsford cancelled his business licence, but Felger continued to run the location as a “political office.”
Felger has run for office numerous times at the municipal and provincial levels.
While at the Abbotsford location, Felger was arrested and charged in May 2009 with seven offences – six counts of trafficking in a controlled substance and one count of possession for the purpose of trafficking.
But he was acquitted of all charges last December, after the judge threw out all the evidence, saying police had breached Felger’s charter rights during their investigation.
Felger’s lawyer had argued that police had repeatedly come into this Abbotsford store, amounting to unauthorized searches, prior to a drug warrant being served and his subsequent arrest in May 2009.
The judge agreed that police had trespassed on Felger’s property.
