A legal matter over property in the BX-Swan Lake region has ruled in favour of the Regional District of North Okanagan.
RDNO has received confirmation of a successful conclusion in the matter of legal action taken towards the owners of a rural property in electoral area B.
The Regional District has recently obtained a court order to allow for the issuance of an injunction to discontinue an illegal use of a two-family dwelling (duplex) as a multi-family dwelling (fourplex).
“The regional district should be making efforts to consistently enforce land use regulations, especially where the regulations involve the health and safety of building occupants,” said electoral area B director Mike Gavinchuk.
Regional district compliance officials advised the owners of the subject property of the local regulatory requirements restricting the number of dwelling units on the property to a maximum of two.
The owners chose to dispute the authority of RDNO to enforce the local zoning bylaw regulations which resulted in legal action and the regional district’s receipt of the previously mentioned court order.
The property owners have now received the necessary approvals from the regional district allowing for alteration of the subject building to a compliant two-family dwelling use.
